DMV appeals the circuit court's order denying its appeal of the decision of the Office of Administrative Hearings that reversed respondent's license revocation. The OAH and circuit court found that DMV failed to prove that respondent was "lawfully arrested" pursuant to West Virginia Code § 17C-5A-2(f).
