Intentional understaffing of the Heartland Nursing Home in Clarksburg, West Virginia led to the unnecessary death of a resident, a relatively young woman who had entered the facility for rehabilitation, and died of severe neglect leading to gangrene.

In Homeowners v. Construction Company, defective workmanship affected an entire community and subjected the families living in that community to a toxic exposure. Since the Defendant, a national construction company, refused to take any responsibility, Bordas & Bordas instituted litigation and comprehensively defeated the defenses claimed by the construction outfit. Ultimately, the group, approximately thirty-five families, were able to settle their claims confidentially for a total of $18.5 million.

Corporate negligence killed the victim at a Tyler County, West Virginia natural gas “pigging” station. He suffered burns over almost his entire body. Bordas & Bordas’ Scott Blass led a comprehensive investigation uncovering company records, emails, text messages and other information that proved the company knew of the serious dangers at the facility, but failed to address them, costing the victim his life.

A Wood County jury returned a verdict of $16,922,000 against Walmart as a result of its failure to maintain its premises in a reasonably safe condition when attempting to apprehend a shoplifter in February 2015 which led to injuries to one of its customers Diane Ankrom. The jury deliberated for less than two hours before reaching its verdict which included $6.5 million dollars in past and future medical expenses and over $10 million in general damages. The jury found Walmart to be 30% responsible for the incident and the shoplifter to be 70% responsible. The verdict is believed to be one of the largest, if not the largest, verdicts in the history of Wood County on behalf of a single plaintiff.

The Cox and Bigler families faced a serious tragedy when an auto accident led to a death. Horribly, the insurance carrier involved refused to pay the claim in a fair and timely manner, trying to portray the insurance policy as cancelled. The record-setting $11.5 million verdict was upheld after multiple appeals and remains one of the most significant verdicts ever returned in southeast Ohio.

Wife, mother, and first-grade teacher lost her life at Camden-Clark hospital in Parkersburg when she was overdosed with anesthesia, and neither the doctor, nor the hospital personnel noticed she had stopped breathing until she had turned blue on the operating table.

Bordas & Bordas recently represented the family of a retired West Virginia man who was killed as a result of unsafe driving by a commercial truck driver and poor training and selection of drivers by companies in the trucking industry. We were able to obtain a settlement of $5 Million.

Bordas & Bordas recently settled a breach of contract claim on behalf of a small oil and gas drilling company in Ohio against a major national oil and gas corporation for $4.5 million.
