State of West Virginia v. David L. Welch

Case Number:
11-0459
Case Issue:

Petitioner appeals from his convictions on one count of first degree murder, nine counts of second degree sexual assault, and three counts of first degree sexual abuse following a jury trial. Petitioner was sentenced to life without mercy on the murder conviction; ten to twenty-five years on each of the nine second degree sexual assault convictions; and one to five years for each of the three first degree sexual abuse convictions. The circuit court ordered the sentences to be served consecutively. Petitioner seeks a reversal of his convictions and a remand so that his initial plea agreement, which was rejected by the circuit court, may be considered by new judge. In the alternative, petitioner seeks a reversal of his conviction for felony-murder and either an acquittal or a new trial on that charge.
