Prosecuting Attorney seeks a writ of prohibition to prohibit the circuit court from enforcing an order dismissing criminal charges against respondent, Joe Rosenthal. Petitioner claims order is in violation of the laws of the State. Criminal charges of illegal possession of wildlife in violation of WV Code §20-2-4 should have been dismissed based upon the ruling that the accused was a "duly authorized agent" of the Dir. of the WV Div. of Natural Resources.
