The Caldwell Plaintiffs appeal from the circuit court's Order Granting In Part and Denying In Defendant's Motion for Judgment as a Matter of Law or a New Trial in which the court struck the testimony of Plaintiffs' expert witnesses. The court granted the Defendants, Western Pocahontas Ltd. Partnership and Western Pocahontas Corp., judgment as a matter of law or, in the alternative, a new trial if this Court reverses the judgment as a matter of law.
