After the settlement of a 2006 condemnation action, petitioners filed suit against respondents alleging that respondents negligently failed to reclaim a portion of petitioners’ property. The circuit court found that petitioners’ claims were barred due to res judicata and collateral estoppel. Petitioners appeal the order of the Circuit Court of Harrison County that granted summary judgment to respondents on the grounds of res judicata and collateral estoppel.
