Petitioner Lightning Energy Services, LLC appeals the order of the Circuit Court of Kanawha County, entered November 6, 2013, affirming the final decision of the Workforce West Virginia Board of Review. The Board of Review adopted the decision of the administrative law judge that determined that respondent was discharged from his employment, but not for misconduct, and therefore eligible for unemployment benefits.
