Petitioner West Virginia Department of Health and Human Resources appeals the August 27, 2014, order of the Circuit Court of Kanawha County that directed the DHHR to immediately restore to patient advocates at the State’s two psychiatric hospitals (1) access to patients and patient units, without limitation, and (2) access to patient records (including all medical records), without limitation, except when patients request limitations on the disclosure of their individual identifiable health information. The circuit court’s order further ordered that the DHHR shall not limit patient advocates’ conversations or discussions with the hospitals’ staff.
