The W.Va. Department of Environmental Protection appeals the circuit court's order which affirmed a decision of the W.Va. Public Employee's Grievance Board. The Grievance Board ruled that the DEP must reinstate, with back pay, an employee who the board concluded had rescinded her voluntary resignation before the DEP accepted it.
