This Appeal arises out of dispute between the petitioner, Trulargo Construction Company and the respondent Allied Waste Services of North America, LLC. Following the petitioner’s purchase of four roll-off waste containers, which they rent to customers when not in use, the respondent filed a complaint with the Public Service Commission. In the complaint, the respondent requested an investigation and issuance of a “Cease and Desist” order against the petitioner. After a hearing, the Public Service Commission granted the respondent’s request. The petitioner argues in the appeal that they aren’t subject to regulation by the Public Service Commission.
