Petitioner appeals the circuit court's order denying his motion for a new trial, arguing that the circuit court erred at trial in allowing introduction of evidence of a test pool stick that was not shown to be the same or similar to the actual stick used in the commission of the offense, and further that it was error to refuse his motion for a new trial based on juror misconduct.
