Petitioner appeals the dismissal of his civil action pursuant to Rule 12(b)(6). Petitioner, who is the executor of the decedent’s will that was executed in 2012, sought to challenge a new will that was executed by the decedent in 2014, in the State of New York, ten days prior to her death.
