Commissioner of the West Virginia Division of Motor Vehicles (“DMV”) appeals the January 31, 2014, order of the Circuit Court of Wayne County that reversed a Revised Decision of Hearing Examiner and Final Order of Chief Hearing Examiner entered June 28, 2013, affirming the Commissioner’s revocation of Respondent Jason Thompson’s driver’s license for driving under the influence of alcohol. The revised decision effectively granted the DMV’s motion for reconsideration of a previous Final Order of the Chief Hearing Examiner, entered on May 16, 2013, that had reversed the revocation order and companion Order of Disqualification and reinstated Mr. Thompson’s driver’s license.
