Petitioner appeals the order of the Circuit Court of Kanawha County upholding the order of the Office of Administrative Hearing regarding the DMV’s revocation of respondent Riner’s driver’s license. In its May 16, 2013, order, the OAH affirmed, in part, the DMV’s revocation for driving under the influence but reversed, in part, the DMV’s revocation for refusal to submit to a secondary chemical test.
