Petitioner Mike Harper, plaintiff in declaratory judgment action below, appeals circuit court's order granting summary judgment to respondent Gavin Smith holding that he is the owner of the real estate in question, arguing there were issues of material fact which should have precluded entry of summary judgment for respondent.
