Plaintiff appeals circuit court's order granting summary judgment to defendant engineering company, arguing inter alia, that the surveyor who incorrectly prepared the elevation certificate for the plaintiff was acting as an agent of the respondent company at the time of this negligence. The plaintiff asserts that the circuit court erred in finding that agency was a question of law for the court when material facts were in dispute.
