Petitioner appeals the order of the Circuit Court of Kanawha County, entered December 9, 2013, setting aside the decision of the West Virginia Public Employees Grievance Board that concluded respondent was properly terminated after petitioner determined respondent was unable to safely perform his duties as a school bus operator. Justice Workman disqualified.
