Petitioner appeals the circuit court’s order granting respondent’s motion to dismiss or, in the alternative, motion for summary judgment. He contends that the circuit court’s ruling was premature in that petitioner was not permitted to engage in discovery. He argues that the court erroneously determined that his claims were barred by res judicata and/or collateral estoppel and, further, that the court improperly weighed the evidence. Petitioner also argues that court erred in denying his motion for leave to file supplemental response to respondent’s motion for summary judgment.
