Petitioner appeals from the circuit court's order granting partial motion to dismiss petitioner's amended cross-claims against respondent in this construction dispute. In a subsequent order, the circuit court's rulings were made final under Rule 54(b) of the West Virginia Rules of Civil Procedure for purposes of an appeal. The issue on appeal relates to the statute of limitations applicable to petitioner's amended cross-claim against respondent.
