Domenick Marrara, Jr. et al. v. Riley Associates
This appeal arises from an action that determined the value of the distributional interest of a dissociated member of a limited liability company ("LLC") pursuant to West Virginia Code § 31B-7-702(e) ("Section 702(e)"). Petitioners, together the dissociated member, agree with the valuation, but appeal a February 20, 2013, order finding that the interest on that value did not began to accrue until the date of the evidentiary hearing where the value was determined. Petitioners argue that, pursuant to Section 702(e), the circuit court should have ruled that the interest began to accrue on the date the dissociated member gave the LLC notice of disassociation.
