Petitioner, DMV Commissioner Stephen O. Dale, appeals the order of the Circuit Court of Boone County, entered on September 5, 2012, that reversed the order of the Office of Administrative Hearing ("OAH"), entered on October 18, 2011. The OAH found that respondent, Amanda Dingess, had operated a vehicle under the influence of alcohol in West Virginia.
