Petitioner, the Board of Zoning Appeals (the "BZA") for the Town of Shepherdstown appeals the order of the Circuit Court of Jefferson County, entered June 4, 2013, that reversed the decision of the BZA and reinstated the decision of the Town of Shepherdstown's Planning Commission which denied Respondent Borys Tkacz's neighbor's request for a building permit.
