Petitioner appeals the order of the Circuit Court of Monroe County that dismissed petitioner’s Motion to Compel, as moot, after granting summary judgment in a companion case. Respondent entered into a Settlement Agreement with petitioner regarding a boundary line dispute, and subsequently sold her property at auction. Respondent refused to formalize the settlement agreement after the sale of the property. The circuit court did not rule on the grounds of this action, but found that the action was moot, after granting summary judgment to the buyers of the property, finding lack of privity, unclean hands, and that petitioner slept on its rights.
