Alex Energy, Inc. appeals the circuit court’s final order affirming the decision of the Environmental Quality Board that rejected WVDEP’s issuance of a discharge permit to Alex Energy because the permit failed to include enforceable, numerical effluent limits to ensure compliance with selenium water quality standards.
