The petitioner Alcan Rolled Products Ravenswood, LLC, appeals the Kanawha County Circuit Court’s order, which reversed the Board of Review and the Administrative Law Judge’s decision that the respondent Terry W. McCarthy engaged in “gross misconduct” under West Virginia Code § 21A-6-3. In reversing the Board of Review, the circuit court held that respondent is entitled to unemployment benefits. In this appeal, the petitioner requests that this Court set aside the circuit court’s order and reinstate the decision of the Board of Review.
