What Type of Damages Will a Car Accident Settlement Cover?
Typically, a car accident settlement can cover damages for personal injuries and property damage. Your damages for personal injuries will include your medical bills incurred for treating your injuries, as well as any future medical bills that are reasonably certain to be incurred for future medical treatment based upon the opinion of one or more physicians.
Similarly, it will also cover any loss of wages you incurred as a result of your personal injuries causing you to miss work. If your personal injuries are permanent or will last into the future for an amount of time to a reasonable degree of medical certainty, you can also recover for such future loss of wages or, if permanent, for an impairment to your future earning capacity provided such loss is supported by an expert, including a physician.
You can also recover general damages for past and future (if reasonably certain to be incurred), physical pain and suffering, emotional distress/mental anguish, and loss of enjoyment of life. Your loss of enjoyment of life damages will include a payment for those activities of daily living and enjoyment that you could not perform due to your personal injuries.
As to property damages, assuming the insurance company has not already paid you without the necessity of contacting an attorney, you will be entitled to recover for the costs of repairing your vehicle or replacing it if the loss is total, as well as damages for loss of use, including the cost of a rental vehicle for a reasonable period of time during which your damaged vehicle was being repaired or replaced.
