Wheeling Surgical Error Attorney

Bordas & Bordas has frequently been called upon to handle cases of medical malpractice involving surgical misadventures. The egregious and tragic case of Roberts v. Murthy was one such case wherein a surgeon essentially fabricated a never-before-performed procedure on the fly and without informed consent, leading to devastating personal injuries to the victim.

Bordas & Bordas aggressively litigated the case, assembling a team of leading experts to address the issues. The case was tried to verdict, and the jury awarded more than $5.6 million to the plaintiffs in 2007. Likewise, Haught v. Weirton Medical Center was a case wherein two surgeons who had never met or appropriately planned a surgery attempted a procedure they were ill-prepared to perform. The result was an unintentional stomach perforation that ultimately claimed the life of the victim.

Bordas & Bordas also uncovered evidence that the defendants had concealed important information about the case in the discovery process and that the hospital had joined in that process as well as inappropriately credentialed the relevant physicians.

After settling with the doctors, Bordas & Bordas proceeded to trial against the hospital. The jury was selected in May 2009 and as soon as it was impaneled, the hospital elected to settle for the full amount of its self-insured retention plus the plaintiff's litigation expenses, a total of $2,060,000.

Surgical Errors

There is inherent risk in any surgery. Nonetheless, we expect surgeons to perform their duties in a competent manner. When their care falls below an accepted professional standard and injury is the result, it may be a case of medical malpractice.

Surgical errors can take many forms, including:

  • Accidentally nicking vital organs
  • Wrong site surgery
  • Leaving instruments in the body
  • Anesthesia errors

Patients who suffer surgical errors can suffer serious setbacks that exacerbate the problem they had surgery for in the first place. Malpractice by surgeons and other operating room staff can leave a patient with serious injuries and even result in wrongful death.

Our attorneys have successfully handled numerous cases involving surgical errors and can help you pursue full and fair compensation for the losses you have suffered.
